TERMS OF SERVICE

1. ACCEPTANCE OF TERMS

By downloading, installing, or using CallSign ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and Vivente Unlimited ("Company," "we," "our," or "us").

2. DESCRIPTION OF SERVICE

CallSign is a secure, end-to-end encrypted messaging application designed to protect your communications. The App allows users to send encrypted messages, discover contacts who also use CallSign, and communicate with enhanced privacy features.

3. ELIGIBILITY

You must be at least 13 years old to use CallSign. By using the App, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

4. USER ACCOUNTS

  • You are responsible for maintaining the confidentiality of your account credentials
  • You are responsible for all activities that occur under your account
  • You must provide accurate information when creating your account
  • You must notify us immediately of any unauthorized use of your account
  • We reserve the right to suspend or terminate accounts that violate these Terms

5. ACCEPTABLE USE

You agree NOT to use CallSign to:

  • Violate any applicable laws or regulations
  • Send spam, phishing attempts, or malicious content
  • Harass, threaten, or intimidate other users
  • Distribute illegal content or materials
  • Attempt to circumvent security features
  • Impersonate others or create fake accounts
  • Interfere with or disrupt the service
  • Collect or harvest user data without consent
  • Use the service for any illegal activities

6. ENCRYPTION & SECURITY

CallSign provides end-to-end encryption for messages. You acknowledge that:

  • We cannot access the content of your encrypted messages
  • We cannot recover lost encryption keys or passwords
  • You are responsible for backing up important information
  • Security features like biometric locks are your responsibility to enable

7. INTELLECTUAL PROPERTY

The App, including its code, design, logos, and content, is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes. You may not copy, modify, distribute, sell, or lease any part of the App without our written consent.

8. DISCLAIMERS

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. YOUR USE OF THE APP IS AT YOUR OWN RISK.

9. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE APP.

10. INDEMNIFICATION

You agree to indemnify and hold harmless Vivente Unlimited and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the App or violation of these Terms.

11. TERMINATION

We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the App will cease immediately. You may delete your account at any time through the App settings.

12. CHANGES TO TERMS

We reserve the right to modify these Terms at any time. We will notify users of significant changes through the App or by other means. Your continued use of the App after changes constitutes acceptance of the modified Terms.

13. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
